163 Earned VA Disability Presumptives Listed Below

163 VA Disability Presumptives (automatically approved if you qualify). Page down to see the list.

Some diseases are conflict specific, such as Vietnam or Middle East wars. Some require an additional diagnosis before getting a rating. Some say yes, and give the diagnosis a zero rating.  The most common zero award is hearing loss, because the VA will give FREE hearing aids and batteries for life.  These hearing aids are top of the line and work amazingly well - even in rooms with lots of noise, like restaurants and neighborhood get-togethers.  Much better than the ones from a few years ago.  I know, because I have had both.

If you are declined, don’t go off the deep end. You can appeal. Also, see why you were declined. You may have headaches, but they don’t rise to the level needed for a disability rating. You may have back pain or arthritis, but again it doesn’t rise to the level needed.  However, it may be because you answered the disability doctor's questions wrong during your examination or you may have failed to show a service connection.

Think before you answer.  Why is the question being asked?  Don't add to your answer with details that weren't asked.  This is like being put on trial.  Most disability doctors that I have met want you to have your claim awarded.  But if you mention that you are fine now to the disability Doctor, they will put this in their notes and you will be DECLINED.

That being said, ask to be evaluated for everything on this list that you have been diagnosed with. Remember, by policy, the VA Health Care system can NOT tell you about an illness that has a high probability of a rating. In fact, they can’t even help you with a submission, even though your VA Doctor is the one who diagnosed it.  By VA policy,VA Disability Exam Doctors are totally separate from the VA Healthcare Doctors.

VA Disability does look at your VA medical records.  If you are not in the VA Healthcare system or you are applying for something that the VA hasn't treated you for, you must get your private Doctor's notes and submit those with your application - or bring with to your disability exam (if you apply for more than one disability, then you typically will have multiple exams).

There are 163 diseases and injuries listed here. Is this all of them? No. These are the ones I could find. If you have a diagnosis that you think might be related to your service that isn't listed here, do a Google search for “VA Disability XXXXX”. That’s how I found three of mine which are included here.  If you find some additional ones, please let me know.

Presumptives that have agent orange indicated after the disease does not mean other causes don't apply.  It is just there to show what presumptives are available to those of us who served in Vietnam and the First Gulf War or in Afghanistan or Iraq.

Secondary Conditions are extremely important.  160% of my 220% in awards are secondary to my primary awards.  Let's say that you broke your ankle on active duty.  The Military doctors put it in a cast and you were good to go.  30 years later you develop crippling arthritis in that leg.  The arthritis itself doesn't qualify, but as a "Secondary Condition" it probably will.

This link will give you some more illustrations.  This is for additional  information only.  Click this link to read about other suggestions:  SECONDARY CONDITON.    Don't waste money on an attorney.  They don't do anything that the FREE services offer and have no better success.

There are many organizations that provide VSO (Veteran Service Officer) services for free, such as local American Legions and VFWs.  In El Paso County, I recommend the El Paso County Veteran Services across from the east Costco.  An appointment is required:  719-520-7750.  These people are paid by El Paso County, are all Veterans and their only purpose is to get you your earned disability award.

And if you are retired military and get rated at 50% or more, then you CAN collect both Retirement Pay and VA Disability without losing ANY of your Retirement pay.  If less than 50%, then you need to choose one or the other.  However, it is still good to be in the system.  As you get older, things start to happen and getting to 50% really isn't that hard.

VA Disability awards are benefits that you earned.  These result in benefits that you, your spouse and your children deserve.

I would like to stress that just because you suffer from one of these issues, that doesn't mean you will get an award.  You need to tie it to your service or to a VA doctor or hospital procedure that resulted in the diagnosis.  You don't have to show negligence.  Not sure if your condition is applicable?  Ask your VSO or call Kent at 303-618-6131
